Dartford man issued with Criminal Behaviour Order after carrying out anti-social behaviour and playing loud music

A homeowner who blasted loud music day and night leading to complaints from a nearby school and neighbours has been fined more than £9,000.

The resident in St Albans Road, Dartford received multiple warnings from the council but he continued with the anti-social behaviour.

Ainsley Fernando has been issued a Criminal Behaviour Order (CBO) for three years after Dartford council visited the property on numerous occasions and issued him verbal warnings and written warnings.

He was also issued with multiple Community Protection Warnings and official notices and even fined by the council.

But when the anti-behaviour continued, police and council officials were granted a warrant and the equipment was seized from the property during a raid on August 14, 2019.

He was also served with a civil injunction at the County Court which was put in place for two years to not disturb his neighbours and is due to expire in August.

The council said despite the orders and the injunction, Fernando continued to persist in carrying out anti-social behaviour, causing regular disturbance to neighbours through excessive noise and "noxious fumes emanating from the property".

A hearing at Medway Magistrates' Court saw Fernando issued with the CBO for breaching the conditions set after the initial warrant and injunction.

Fernando, who did not attend the hearing earlier this year, was convicted for four breaches of the Community Protection Notice and issued the fines.

The CBO means any future reports of a disturbance caused by Fernando will be regarded as a criminal offence and could lead to an arrest.

The court heard further evidence from the council to support allegations of the problems persisting after action was taken in August 2019.

The order on Fernando will remain enforced for three years and he must inform the council if he changes address.

Council spokesman Caroline Green said: “This an excellent outcome. Dartford Borough Council has been dealing with the individual in relation to persistent noise nuisance for some time.

"His behaviour was having a detrimental effect on the community but, as a result of perseverance and joint working across council departments and Kent Police, residents living in St Albans Road can now have some peace and quiet.”
