A man could be thrown out of the UK...even though he has been cleared of stalking a Dover mum.

Czech-born Jaroslav Botola was found not guilty at Canterbury Crown Court of harassing the woman last year.

But the jury was not told that Botola, 49, of Dryden Court has two convictions for rape in his native Czech Republic.

Now a judge has ordered senior Crown Prosecution Service lawyers to write to the Home Office to review his right to remain in the UK – despite being an EU citizen.

And Judge Simon James also issued a new five-year restriction order banning Botola from going to many parts of Dover town centre.

He had been arrested by police after a complaint from the woman – who cannot be named for legal reasons – that she was being stalked.

Botola was already under a restriction order after a conviction for stalking against the same woman and a public order offence in 2013 – against the same victim after using threatening words.

He didn’t give evidence during the three-day hearing but in a statement to police Botola claimed it was just coincidence he was seen standing near the woman.

But the jury was not made aware that he had been jailed for three years in Ostrava in 1985 and sent to prison for another three years in Karvina in 1997 – both times for rape.

Judge James said that despite the jury’s verdict he felt it important that the Home Office was alerted about the sex attacker’s past and then review his right to remain in Britain despite his EU citizenship.
