A drinker threw beer over his girlfriend and kicked out at her “recklessly” during an argument.

Andrew Hindry chucked the contents of his can over his partner after a row “spun out of control” in Folkestone in August last year.

The 50-year-old was later arrested and charged with common assault.

Hindry, who gave a care-of address as Tontine Street, had admitted the offence when he appeared in court in March and a pre-sentencing report was ordered.

He returned to Folkestone Magistrates’ Court on June 22 to be sentenced.

Jeremy King, prosecuting, told the court the incident happened on August 8, 2022.

Mr King said: “It’s a domestic violence-related case. The victim is not supporting the matter which involves him throwing the contents of a beer can over her and kicking out at her recklessly.

“Both parties have issue with drink and he has previous convictions, but none related to the same victim.”

The court also heard Hindry was under the influence of alcohol when he committed the offence and since then, there had been no further incidents.

The bench was also told Hindry and his partner had now reconciled and both had alcohol difficulties.

The court heard Hindry earns £250 a week when he is working but had been suffering from a problem with his shoulder lately.

Chairman of the bench Stephen Rogers said: “You committed a common assault in a domestic environment which spun out of control very easily. It’s clear you have a drink problem.”

Magistrates placed Hindry on a 12-month community order which will see him complete 25 rehabilitation sessions to look at his drinking habits.

He was also fined £250 and ordered to pay a victim surcharge of £114 and £85 costs.
