A marketing director from Gravesend who pre-ordered a new iPhone 11 Pro has been left £1,300 out of pocket after it was delivered to another address.
The iPhone, which cost £1,299, was due to be delivered to his work on the day of its release, but it never arrived.
James Scutts pre-ordered it from Argos as a treat for himself and was going to cash in his old phone for £600 to help towards the cost.
However, despite tracking the new device, which was being delivered by Yodel last Friday, to just two delivery slots away from his work, the iPhone was never delivered to him and was signed for at another address by someone called J Collins.
Mr Scutts, 32, who is married said: "I stopped tracking the iPhone as it was just two delivery slots away and thought it would arrive in a short time.
"When it didn't, I checked again to see where it was and it said it had been delivered."
Mr Scutts immediately contacted both Yodel and Argos and both companies said they would investigate the matter.
However, Argos later told Mr Scutts they had closed the investigation as the phone had been delivered and signed for and he should seek independent legal advice about the matter.
Yodel is still investigating but has still not told Mr Scutts where his phone is or where it was delivered to.
The company has told him a driver will return to the address it was delivered to, but as yet he has not had an update from Yodel about that.
Mr Scutt added: "I have offered CCTV showing no delivery driver came to deliver it to my work address, but Argos didn't want to know.
"It's just not good enough they have closed the investigation, because I never signed for it.
"It's been delivered to the wrong address, Yodel has admitted that, and Argos is simply telling me to take legal action to take it to court to get the money back.
"Yodel will not tell me where it was delivered either.
"I have now had to fill in a money claim online so I can take Argos to court to just get my money back.
"The customer service at Argos is a joke.
"They just don't care I have lost out all this money and so I have no alternative than to take the company to court.
"Even if the driver does knock on the door there is no guarantee the phone will be handed over.
"I can't even report it as stolen as it is technically not mine, so whoever has it can still use it as Argos will not be reporting it as stolen as they've closed the case, so the phone is still active.
"I would urge anyone thinking of pre-ordering a phone from Argos, not to bother."
In a response to a Tweet Mr Scutts published about the situation Argos said: "Hi, James. I am sorry to see that this is not the outcome you wanted however after having a look into the order I can see that we have the order marked down by Yodel as delivered and signed for, this is why we advised seeking independent legal advise."
