An application has been submitted to dismiss charges made against two men accused of attempted murder.
It follows an incident in which a 31-year-old man suffered an arm injury after a shooting in Cooper Close, Greenhithe.
An investigation was launched by the Kent and Essex Serious Crime Directorate last month and five arrests were made – including the man who got shot.
Christopher Nourse, 41, of Ospringe Close, Penge, and Colin Nourse, 38, of Cooper Close, Greenhithe, were later charged with attempted murder.
An application to dismiss the charges has now been listed with Maidstone Crown Court to be heard on May 29.
They were due to stand trial on September 1.
