The latest results from the courts around Kent

Fraudsters, a drink-driver caught more than four-times the legal limit and a persistent 999 hoax caller are among those to face justice in Kent's magistrates' courts in this week's round-up.



Thief and attacker sentenced

Homeless David Layton stole goods worth £167.25 and assaulted a man at a supermarket in Romney Place, Maidstone.

Magistrates sentenced 44-year-old to eight weeks in prison, suspended for a year. He must also pay £85 costs and a £115 victim surcharge.

Drink driver banned

Simon Davis, of Manley Boulevard, Snodland, drove a BMW 4 Series in Manley Boulevard, and gave a breath test of 92 microgrammes of alcohol in 100 millilitres of breath. The legal limit is 35 microgrammes.

Magistrates banned the 45-year-old from driving for a year and a half. He must also pay a £750 fine, £85 costs and a £75 victim surcharge.

Unpaid work for worker who stole £8,000 from employer

Between September 5 2015 and March 6 2016 Martine Shirtcliff of West Heath Lane, Sevenoaks, stole £8,000 from her employer at a rugby club in Plymouth Drive, Sevenoaks.

Magistrates ordered the 50-year-old to carry out 300 hours of unpaid work in the next year. She must also pay £8,500 compensation, £440 costs and a £60 victim surcharge.

Prison for five time shoplifter

Lee Stych, of Knightrider Street, Maidstone, stole meat worth £30 and legs of lamb worth £36 from a supermarket in Loose Road, Maidstone.

He then stole meat worth £40 from a supermarket in Farleigh Hill, Maidstone.

He also stole groceries worth £18.28 from a shop in Parkwood Parade, Maidstone.

Most recently, he stole chocolate worth £108.98 from a shop in Week Street, Maidstone.

Magistrates sentenced the 43-year-old to 120 days in prison. Because the offences were committed during the operational period of a suspended sentence, the overall length of his sentence is 240 days. He must also pay a £115 victim surcharge.

Year-and-a-half ban for drink driver

Vicky McCulloch, of Upper Fant Road, Maidstone, drove a Fiat 500 in Well Road, Maidstone, and gave a blood test of 156 milligrammes of alcohol in 100 millilitres of blood. The legal limit is 80 milligrammes.

Magistrates banned the 25-year-old from driving for a year and a half. She must also pay a £350 fine, £85 costs and a £35 victim surcharge.

Man with cannabis handed unpaid work order

John Smith, of Burston Road, Maidstone, had a 269 grams of cannabis on him in Lancet Lane, Maidstone, with the intent to supply it.

Magistrates ordered the 24-year-old to carry out 250 hours of unpaid work in the next year. He must also pay £600 costs and an £85 victim surcharge.

Teen attacker behind bars

Homeless Benjamin Penkert assaulted a man at a shop in Station Road, Longfield.

Magistrates sentenced the 19-year-old to a fortnight in prison. He must also pay £85 costs and a £115 victim surcharge.

Prison for one man who assaulted a police officer

Nicky Gale assaulted a police officer at a police station in Thames Way, Northfleet.

Magistrates sentenced the 34-year-old to 60 days in prison.

Shoplifter and cannabis possessor sentenced

Cameron Oakes, of Bellflower Avenue, Sheerness, stole garden and aquatic equipment, patio heaters and garden vacuums worth an unknown amount from a garden centre in Courteney Road, Gillingham.

He also stole a bag and nine sets of virtual reality headsets worth £194.90 from a shop in St Peter’s Street, Maidstone.

He then stole meat worth £75 from a supermarket in Millennium Way, Sheerness.

The 19-year-old stole two DVD players and two cameras worth £119.98 from a shop in Thomsett Way, Queenborough. He also had a quantity of cannabis on him in St Peter’s Street, Maidstone.

Oakes also stole an electric razor worth £43 from a supermarket in Avenue of Remembrance, Sittingbourne.

Magistrates sentenced him to 40 days in prison, suspended for a year and a half. He must also pay £487 compensation.

Swanscombe fraudster sentenced

Between 1 November 2016 and 18 January 2017 Steven Nicholls, of High Street, made fraudulent refunds to make himself money while working as a shop assistant at a shop in John Street, Rochester.

Magistrates sentenced the 44-year-old to 26 weeks in prison, suspended for a year and a half. He must also pay £2,200 compensation and £85 costs.

Two year ban for one drink driver

Louisa Croft, of Tenterden Road, Chatham, drove a Peugeot 206 in Princes Avenue, Walderslade, and gave a breath test of 141 microgrammes of alcohol in 100 millilitres of breath - four times the legal limit.

Magistrates sentenced the 38-year-old to eight weeks in prison, suspended for two years, and banned her from driving for two years. She must also pay a £300 fine, £85 costs and a £15 victim surcharge.

Man with knife handed curfew

Jusraj Basra, of Beaumont Drive, Northfleet, had a kitchen knife in his possession in Harmer Street, Gravesend.

Magistrates sentenced the 21-year-old to eight weeks in prison, suspended for a year, and gave him an 82-day curfew to remain at home between midnight and 5am daily until May 14. He must also pay £85 costs and a £115 victim surcharge.

Unpaid work for fraudster

Alan Knights, of Berridge Road, Sheerness, made fraudulent applications for credit cards, mobile phone contracts and pay day loans, intending to make a gain of £6,720.

Magistrates ordered the 34-year-old to carry out 150 hours of unpaid work in the next year. He must also pay an £85 victim surcharge.

Driving offender in prison

Lewis Cole, of Wollaston Close, Gillingham, drove a Volkswagen Polo in Walsingham Close, Gillingham, while disqualified and with no insurance. He also failed to stop the vehicle after a road accident where another person was injured.

Magistrates sentenced the 23-year-old to six weeks in prison. He must also pay a £115 victim surcharge.

Year-and-a-half off the road for one driver

Aaron Parnell, of Kestrel Road, Chatham, drove a VW Golf in Corporation Street, Rochester, and gave a breath test of 76 microgrammes of alcohol in 100 millilitres of breath.

Magistrates banned the 29-year-old from driving for a year and a half. He must also pay a £500 fine, £85 costs and a £50 victim surcharge.

Double driving offender banned and handed unpaid work

Sam Hardstaff, of St Leonard’s Avenue, Chatham, drove a Mercedes in White Road, Chatham, while disqualified and with no insurance.

He then drove a Ford Connect in Symons Avenue, Chatham, while disqualified and with no insurance.

Magistrates sentenced the 24-year-old to 16 weeks in prison, suspended for two years, banned him from driving for a year and ordered him to carry out 240 hours of unpaid work in the next year. He must also pay £85 costs and a £115 victim surcharge.

Three year ban for drink driving man

Shane Higgins, of Haig Avenue, Chatham, drove a Ford KA in Shipwrights Avenue, Chatham, and gave a breath test of 49 microgrammes of alcohol in 100 millilitres of breath.

Magistrates banned the 31-year-old from driving for three years. He must also pay a £260 fine, £85 costs and a £30 victim surcharge.

Prison for shoplifter

Homeless Clive Tilley stole food worth £69.50 from a supermarket in High Street, Strood, and steaks worth £16.44 from a shop in Darnley Road, Strood.

He was also drunk and disorderly at Waterfront Bus Station, Chatham.

He then stole meat worth £100.28 from a shop in Station Road, Longfield.

Magistrates sentenced the 34-year-old to 120 days in prison. He must also pay a £115 victim surcharge.

Nuisance phone caller handed unpaid work

Daniel Whiskin, of Beech Road, Dartford, harassed two women in Dartford by making nuisance phone calls.

Magistrates ordered the 26-year-old to carry out 200 hours of unpaid work in the next year. He must also pay £85 costs and an £85 victim surcharge.

Prison and ban for one driver

Shane Tolley, of Witham Way, Rochester, failed to provide a specimen of breath for analysis in Strood.

Magistrates sentenced the 27-year-old to 59 days in prison and banned him from driving for three years. He must also pay £85 costs and a £115 victim surcharge.

Prison for three time shoplifter

Lucy Penrose, of Chelmar Road, Chatham, stole air fresheners worth £84 from a shop in The Pentagon Shopping Centre, Chatham.

She also stole razor blades and a steamer worth £197 from the same shop.

She then stole two irons worth £150 from the same shop.

Magistrates sentenced the 40-year-old to 135 days in prison. She must also pay £431 compensation.

Ban for drink driver

Simone Garbaliauskaite, of Archway Road, Ramsgate, drove an Audi A3 in Marina Road, Ramsgate, with no insurance and gave a breath test of 84 microgrammes of alcohol in 100 millilitres of breath.

Magistrates banned the 27-year-old from driving for a year and eight months. She must also pay a £600 fine, £85 costs and a £30 victim surcharge.

Neil De Klerk, of School Road, Romney Marsh, drove a Vauxhall Vectra in Seabrook Road, Hythe, while disqualified and with no insurance.

Magistrates banned the 27-year-old from driving for a year and 11 months and ordered him to carry out 200 hours of unpaid work in the next year.

He must also pay £85 costs and an £85 victim surcharge.

Two time car thief handed unpaid work

Gary Lown, of Adams Drive, Ashford, stole a Ford Galaxy from Eastry Close, Ashford.

He also stole a Grand Jeep Cherokee from Whinless Road, Dover.

Magistrates ordered the 37-year-old to carry out 250 hours of unpaid work in the next year. He must also pay £150 compensation, £85 costs and an £85 victim surcharge.

Dangerous driver banned

Jon Porter of Oswald Road, Dover, drove a Volkswagen Golf in Harbour Street, Folkestone, dangerously, without a licence and with no insurance.

Magistrates sentenced the 21-year-old to 63 days in prison, suspended for a year, banned him from driving for a year and three months and ordered him to carry out 150 hours of unpaid work in the next year.

He must also pay £85 costs and a £115 victim surcharge.

Serial offender sentenced

Rodney Gowton, of Newington Road, Ramsgate, drove a BMW in Crescent Road, Ramsgate, without a licence and with no insurance.

He failed to stop the vehicle after an accident where another vehicle was damaged and failed to provide a specimen of breath for analysis.

He also assaulted a man in Duncan Road, Ramsgate, and another man in Cumberland Road, Ramsgate.

Magistrates sentenced the 49-year-old to 18 weeks in prison, suspended for a year and a half, banned him from driving for five years and gave him a 16 week curfew to remain at home between 8pm and 6am daily until June 16.

He must also pay £450 compensation and £400 costs.

Man with knuckle duster in prison

Maison Fillis, of Ayton Road, Ramsgate, had a knuckle duster on him at a supermarket in Chatham Street, Ramsgate.

Magistrates sentenced the 20-year-old to 28 days in prison. He must also pay a £115 victim surcharge.

Persistent 999 caller in prison

Between 14 October and 2 December 2016 and between 29 December 2016 and 3 January 2017 Peter Bennett, of Coronation Close, Broadstairs, persistently made 999 calls to Kent Police when there was no emergency.

Magistrates sentenced the 58-year-old to 28 days in prison. He must also pay a £115 victim surcharge.

More than two years off the road for one driver

Adam Pritchard, of Blaxland Close, Faversham, drove a Vauxhall Corsa in Clapham Hill, Whitstable, without a licence and with no insurance. He gave a breath test of 96 microgrammes of alcohol in 100 millilitres of breath.

On another day, he drove a Peugeot 307 in Lewis Close, Faversham, with no insurance. He also had 0.84 grams of cocaine on him and failed to provide a specimen of breath for analysis.

Magistrates banned the 28-year-old from driving for two years and four months, and gave him a four month curfew to remain at home between 7pm and 7am daily until June 22.

He must also pay a £360 fine, £170 costs and a £115 victim surcharge.

Meat thief in prison

Vita Batten, of Manston Road, Ramsgate, stole meat worth an unknown amount from a shop in Grange Road, Ramsgate.

She also damaged a book worth an unknown amount at Margate Police Station.

Magistrates sentenced the 24-year-old to 135 days in prison.
