A boy who suffered serious brain damage in an accident on a birthday party bouncy castle is suing his father and the parents who organised the party for massive damages.

Samuel David Harris was 11 when he suffered a fractured skull after being struck in the head whilst playing on the inflatable at a party organised by Timothy and Catherine Perry, for the 10th birthdays of their triplets.

The party was held at Gordon Junior School playing fields, Jersey Road, Strood, on September 10 2005.

Sam, now 13, was with his father David Harris of Jersey Road, Strood, on the day of the accident, after attending a coaching session for Woodpecker FC, a youth football team run by Mr Harris.

Sam’s parents are not together and through his mother, Janet Harris, of Greenways, Long Lane, Gedney Hill, Spalding, Lincs, he is suing Mr and Mrs Perry, of Jersey Road, Rochester, as well as his father for substantial compensation.

Susan Rodway QC, Sam’s barrister, told Mr Justice David Steel, sitting at London’s High Court, that it is her case that Sam was kicked in the head accidentally by an older boy of 14 or 15 years who was doing a flip on the bouncy castle at the same time he was on it.

Miss Rodway claimed Mr and Mrs Perry breached the duty of care they owed Sam in not supervising the bouncy castle tightly enough and in not preventing children turning flips and somersaults, as well as allowing children of different ages and weights to play on it at the same time.

The defendants, all insured, deny negligence at the High Court in London. The case continues
