The investigation into the fatal shooting of Sittingbourne man Dayniel Tucker, near Sevenoaks last December has been stopped following a legal challenge by members of his family.
A judicial review started at the High Court, London, on Wednesday and was expected to end on Friday.
The review is examining worries over evidence used in the Independent Police Complaints Commission investigation. Concerns have been expressed over the ability of officers to mutually discuss their evidence before it is submitted.
Mr Tucker, 39, of Adisham Green, Sittingbourne, was shot twice by police firearms officers at Stansted, on December 29.
He had been spotted by a villager with an Uzi-type machine gun.
The solicitor for the Tucker family, Tony Murphy of Bhatt Murphy Solicitor, said: "The family hope that this hearing will result in an investigation in which they can have confidence.
“An investigation where witness evidence, including from police officers, is properly gathered and tested.”
IPCC Commissioner Ian Bynoe, said: “I completely understand that Mr Tucker’s family want to ensure that the investigation into the circumstances surrounding his death is thorough and fair.
“The IPCC is committed to working openly and independently to ensure that this happens and I am confident that this investigation has been, and will continue to be, impartial and robust.”
