No crime probe over superbug deaths

Former hospital boss Rose Gibb will not face a criminal investigation over hospital C-diff deaths.

The announcement, the result of a nine-month review into a Healthcare Commission report, was made by Kent Police and the Health and Safety Executive this morning.

Last October, the Healthcare Commission published a report that revealed the bug was "definitely" or "probably" the cause of 90 deaths at the three hospitals run by the Maidstone and Tunbridge Wells NHS Trust between April and September 2006.

The report was passed to the police and the HSE, who have now decided not to take any further action against the trust.

Assistant chief constable Allyn Thomas said: "While the report makes for grim and at times distressing reading our review has not identified any information that would indicate a need or duty to conduct a criminal investigation at this time."

Ann Widdecombe, MP for Maidstone and the Weald, said: "As the necessary corporate manslaughter law did not apply at the times of these deaths, I accept that there is no likelihood of any successful criminal action."
