A youth charity and a girl band on a talent show have more in common than most people might think.
A Tunbridge Wells-based organisation for disabled youngsters shares the same name as an act on this year's series of The X Factor but it's not a happy coincidence.
Rhythmix, which helps disadvantaged children develop their social and personal skills through music, has asked bosses at the ITV1 show to change the group's name but the requests have been ignored.
Mark Davyd, chief executive at the charity, said he had no other choice but to take legal action against Simon Cowell's production company, Syco, and other businesses involved.
A spokesman for The X Factor said: "The charity in question have trademarked the name 'Rhythmix' for educational purposes only, which is not in conflict with the band or the show."
Judges Gary Barlow, Kelly Rowland, Louis Walsh and Tulisa Contostavlos, formed the band with four girls – Jesy Nelson, 20, Perrie Edwards, 18, Leigh-Anne Pinnock, 19, and Jade Thirlwall, 18 – who entered the competition as soloists.
The group will perform on the first live show this Saturday.
