A mum-of-two attacked her neighbour after losing her temper about the amount of noise she was making in the flat above.

Chelsey Allan , 27, assaulted Kirsty Gillespie after a birthday party at the flat in Penrith Court, in Hazlemere Drive, Gillingham.

Allan, who has a son aged seven and a baby daughter, felt too much noise had been coming from Ms Gillespie’s flat, so went upstairs to confront her.

Ms Gillespie’s daughter had been celebrating her fifth birthday on the day in question and Allan lost her temper after the noise woke her children up.

The woman began arguing and Allan grabbed hold of Ms Gillespie’s head and pushed it into a wall.

She continued attacking her and punched her in the face, while shouting, swearing and calling her names.

The fracas was stopped when the pair were pulled apart by someone else, but the incident upset the woman’s daughter who was in the flat.

Ms Gillespie suffering a sore face and bruised head.

Allan was later charged with common assault and pleaded guilty to the offence when she appeared before magistrates in Medway.

Derek Hayward, defending said: “She says the victim laughs at her and sneers at her every time she sees her.

“She has two children, Harry, seven, and Flo, who is 12 weeks and is currently on maternity leave and is a carer of old people through an agency.

“Noise coming from the flat above has been a problem for some time and she has had to remove a chandelier because of the vibrations from it.

“She did not realise it was the girl’s birthday and her children were woken up by the noise.

“Miss Allan tells me she did not go in the flat and says she was grabbed by the hair and retaliated, it was a mutual pushing and shoving rather than a punch.

“However, she is utterly ashamed about what’s happened and she was at her wit’s end.”

Magistrates placed her on a six month community order which will see her placed under curfew for three months.

She was also ordered to pay £100 compensation to Ms Gillespie and £85 costs.

A restraining order was also made preventing Allan from going to her neighbour’s home.

Richard Shepherd, chairman of the bench said: “This was a serious offence.

“Deal with it differently if it happens again.”
