A pervert who avoided jail after he performed an indecent act on himself in a high street has been jailed after committing further crimes.
Ryan Zuczok was caught in possession with a knife for the second time – putting him in line for a minimum six-month jail term.
Now, the 24-year-old has been locked up for 10 months, having also breached a suspended sentence.
Zuczok, of Clarence Road, Chatham, admitted the indecency charge and sentence was adjourned for reports, with an indication from Judge Philip Statman that he would not be jailed.
But in the meantime he was caught with the blade on him in a public place.
Maidstone Crown Court heard Zuczok’s mother was a heroin addict and a result he had to be weaned off the “pernicious substance” when born.
He had ADHD and mental disorders which were exacerbated by his use of drugs and alcohol.
Judge Statman said he had to anxiously consider how best to assist Zuczok and also protect the community.
“Regrettably, even bearing in mind your mental health difficulties and all I have been told about what has happened between then and now, you have gone and committed what I consider to be a serious criminal office,” he said.
“Having any form of weapon these days, particularly a knife in a public place, is something that causes great consternation in the community as a whole.
“So great is the concern that Parliament has recently legislated to ensure that minimum sentences are imposed in cases where a knife is carried and leads to a second criminal offence.
“That applies to you. I regret to say I cannot deal with this case today by anything other than an immediate custodial sentence.”
Zuczok was sentenced to five months and two weeks for having a bladed article, three months consecutive for breaching the suspended sentence and a further six weeks for outraging public decency.
"At the root of this is here is a defendant who was given a clear warning by me what would happen..." Judge Statman
Prosecutor Rebecca Upton said a mother was at home in Luton High Street with her two children when she saw Zuczok bending over as if in pain.
But she then saw him pull down his jogging bottoms and perform indecent acts on himself. She told her 14-year-old daughter not to look.
She called the police and Zuczok was arrested. She said she was sickened by what she saw and the images would not leave her head.
He admitted the charge and was given the no jail indication on August 15 last year.
But when he returned to court on February 14 the judge was told about the further offending on November 17.
Miss Upton said police officers saw Zuczok looking “out of it” in a daze and waving his arms around. He was holding a hairbrush.
He was searched and the knife was seized from his pocket. He said he had taken drugs and drunk alcohol.
He had 21 previous convictions for 30 offences. He was given a suspended sentence in 2015 for possessing an offensive weapon.
He was in breach of a 160-day suspended sentence for assaulting his girlfriend, grabbing her by the neck and squeezing. He then headbutted mirrors in three rooms.
“Weapons in the current climate are causing profound concern..." Judge Statman
Mary Jacobson, defending, said Zuczok was acutely aware he had not only let himself down, but also let down the judge.
He had been helped by a carer previously, but the funding was stopped. It had since been reinstated.
Zuczok was on three different types of medication and became “unfunctional”.
Judge Statman said: “At the root of this is here is a defendant who was given a clear warning by me what would happen and has then been caught with a weapon.
“Weapons in the current climate are causing profound concern. Defendants have a responsibility as to whether or not they are going to commit further offences.”
The judge added that Zuczok should be given assistance with his mental health difficulties when released from prison.
