A man has been fined after a load of rubbish was dumped under the M2 Bridge at Borstal in Rochester.

Steve Smith, 42, was due before magistrates in Medway after a large amount of items were dumped under the bridge near Warwick Crescent, in July last year.

Rubbish included car parts, toys and letters.

Smith, of Luton Road, Chatham, was due in court at the end of March after he failed to respond to a notice served under S108 of the Environment Act 1995, which was sent to him by environmental enforcement officers from Medway Council.

The court heard how council officers were sent to the scene after the rubbish had been discovered there and gathered the evidence to identify the fly-tipper.

The dumped letters revealed details of his address and officers sent Smith a notice under section 108 of the Environment Act 1995 asking him to answer four questions in relation to the incident.

Smith had four weeks to respond and called the team via to advise them the waste was from a yard he used to use.

However, he failed to comply with the notice he had been served and to answer the questions which would have assisted with the investigation.

Smith was subsequently invited to attend a recorded interview, but he also failed to respond to the request and as a result was summonsed to court for failing to comply with the notice.

Magistrates fined Smith £250 and ordered he pay £270 costs.
