The safety watchdog is "making enquiries" into an incident which saw a person become trapped beneath a vehicle.
The driver of the vehicle was injured after it overturned at Cookham Hill, Borstal, near Sidney Road.
The road was closed for several hours on Thursday.
Paramedics and fire crews also attended the scene and the driver was treated for injuries before being taken to a London hospital for further medical attention.
Following the incident the Health and Safety Executive (HSE) confirmed that it was looking into the incident – however, an investigation has not been launched.
A spokesperson said: “We are aware of this incident and are making enquiries.”
At the time a motorist, who lives in Borstal but didn't want to be named, described the scene.
They said: "As I drove up Maidstone Road, to turn into Priestfields there was an ambulance, an incident support vehicle and a police car all in convoy pulling out of Priestfields and driving up Maidstone Road.
"Then as I went along Borstal Street the police were just putting their blue tape up and were closing Cookham Hill.
"There was a digger in the road and some rubble, I don't know if someone has been injured by the falling rubble or not, but I think it has something to do with that."
A Kent Fire and Rescue Service spokesman also confirmed the services attendance but were not needed.
She said: "The crew helped to make the scene safe, and duty of care was passed to SECAmb and Kent Police."
