Van driver banned from road after crash on M25 near Shoreham tested positive for cocaine

A van driver has been banned from the road for a year after being caught over the drug-drive limit.

The smash was not his fault but when police arrived at the scene he was asked to do a roadside test which came back positive for cocaine.

The 51-year-old was later charged with a drug-driving offence following the incident on July 17 last year.

He admitted the offence when he appeared before Sevenoaks Magistrates' Court earlier this month.

The court heard O'Dwyer, of Kemnal Road, Chislehurst, had 200 microgrammes of Benzoylecgonine (a metabolite of cocaine) in 100 millilitres of blood. The legal limit is 50.

Magistrates were also told O'Dwyer had previous convictions for drink-driving but those were committed some 20 years ago.

The court heard the van driver had taken the cocaine on the Friday and only drove on the Sunday when the crash happened and that he had also taken an impairment test at the time which he passed.

Magistrates also read a letter from O'Dwyer's employer which stated if his licence was revoked he would lose his job as a driver as there was no other position his company could offer him.

This would have a severe effect on his family as he was the main breadwinner, the bench heard.

It was also stated he'd been going through a stressful time in his life which led to the drug misuse.

Magistrates banned O'Dwyer from driving for 12 months and fined him £120 and ordered he pay a £48 victim surcharge and £85 costs.

Chair of the bench Jackie Hamilton said: "Taking cocaine is not OK. Change your behaviour in that respect."
