Russell Brett, managing director of RB Installations in Sunbury-on-Thames, Surrey, appeared at Sittingbourne Magistrates' Court and admitted not making adequate provision for the disposal of waste which was subsequently flytipped.

The court heard how on March 12 last year, Swale council received a call to say Magpie Lane was blocked due to flytipping.

The rubbish consisted mainly of cardboard boxes, tiles and an old kitchen suite. Sticky labels on the boxes provided the names of the people who had recently had new kitchens installed and an investigation revealed the work had been carried out by Brett.

RB Installations holds a waste carrier's licence and is responsible for any waste it has produced and to ensure any disposal is to an authorised person.

Brett said he had given the waste to a sub-contractor but no waste transfer notes were exchanged. The magistrates fined the defendant £300 for each offence, taking into account the defendant's early guilty plea.
