A furious woman, who spat in the face of a stranger four times before laying into her with her feet, has been jailed for three years.

Elaina O’Brien started the bust-up with victim Yana Stewart outside the Caprice Nightclub in Margate in November last year.

Canterbury Crown Court heard how the incident was caught on CCTV and shown to the judge, Recorder Anesta Weekes QC who told her: “Spitting is a particularly appalling thing to do.”

Charles Evans, prosecuting, told how in November last year the women clashed and Ms Stewart, who was left with a facial scar from her beating, was knocked to the ground.

Twice O’Brien, 26, of Arundel Road, Ramsgate, was pulled back by two men but still managed to continue the attack – even though her victim had offered no violence throughout the unprovoked attack.

The prosecutor said: “As Ms Stewart was about to go into the club she was confronted by O’Brien who was standing outside with her boyfriend Joseph Manley.

“For no apparent reason, she began to abuse Ms Stewart, shouting at her and calling her

names. Initially the victim didn’t respond but the verbal attack continued, “ he added.

Ms Stewart demanded to know why O’Brien was screaming, which resulted in the defendant spitting at her several times.

“She then hit Ms Stewart in the head causing her to fall to the floor where she then kicked her twice in the head.

“Ms Stewart managed to get up and the argument continued – while O’Brien’s boyfriend attempted to keep the women apart.

“Unfortunately, he accidentally knocked Ms Stewart with his elbow while trying to restrain his girlfriend and the victim fell to the ground again, this time hitting her head on a wall as she fell.

“As she tried to get up a second time, O’Brien began kicking her several times – and it only stopped when Mr Manley physically picked her up and dragged her away.”

Mr Evans added that O’Brien and Mr Manley walked away but were stopped by police officers.

Furious O’Brien – who was pacing about – told one: “If I’m going to get arrested, you’d better get more cars here because I swear I am going to kick off big time” – she was then handcuffed.

At the police station she said she had been drinking and taking cocaine and, at the club, her boyfriend had been thrown out.

She told police she had gone outside and had got into an argument with the victim after claiming she had said something about her mother.

O’Brien, who admitted malicious wounding and affray, also revealed she was bi-polar and had been advised not to drink while taking her medication.

The judge told her: “In the plain light of day you realise how utterly appalling the incident was.

“You spat at your victim four times which is a particularly appalling thing to do and amounts to an assault. You then pulled and punched your victim to the ground and kicked her.

“And all this happened with two grown men attempting to try and stop you because they realised you were bent on violence.”
