A lorry driver involved in a horror 13-car pile-up in a busy town centre will not face prosecution, it has been revealed.
Mariusz Sudol was at the wheel of his Renault HGV which collided with several vehicles in London Road, Southborough, in June last year.
The 34-year-old, from Poland, was arrested following the huge smash and charged with two offences of dangerous driving and one of failing to stop following an accident.
Alexander Stein, defending, told Maidstone Crown Court in June that Mr Sudol, of St Mark’s Avenue, Northfleet, had suffered “a medical episode of some sort” at the time of the accident.
Prosecutor Danny Moore said at another hearing last month a medical report had concluded Mr Sudol suffered seizures as a result of hyperglycaemia or epilepsy, or both.
This provided a defence of “non-insane automatism” - making his actions involuntary - with only three possible sentencing options - a hospital order, supervision or an absolute discharge.
Mr Moore said there was a question mark over whether the case was in the public interest.
Mr Sudol had his driving licence revoked by the DVLA and would not be able to drive again until certified as fit.
Peter Forbes, prosecuting today, proposed to offer no evidence against Mr Sudol, but could not do so because of a technical point that he had not entered pleas to the charges.
Recorder Amanda Tipples QC adjourned until next Friday, September 16, when Mr Sudol is expected to deny the charges and not guilty verdicts will be entered.
The collision caused London Road to be closed between Speldhurst Road and Western Road for seven hours, with more than nine emergency vehicles and the air ambulance attending.
